This Privacy Policy explains how Lydia Fermer, TFW Collective Ltd ("we", "us", "our"), which operates The Feminine Way Community ("the Community"), collects, uses and protects your personal data. We are committed to protecting your privacy and handling your personal data in accordance with UK data protection law, including the UK GDPR and the Data Protection Act 2018.

WHAT PERSONAL DATA WE COLLECT

We may collect and process the following personal data about you:

  • Identity and contact details – such as your name and email address.
  • Account details – information used to create and manage your membership account.
  • Payment information – your subscription and billing records. Card and bank details are collected and processed directly by our payment providers (Stripe and/or PayPal via Kajabi); we do not store your full card details ourselves.
  • Membership activity – your interactions within the Community, such as posts, comments, contributions and attendance at live calls.
  • Communications – any messages or correspondence you send to us.
  • Technical data – such as your IP address, device and browser information, and how you use our platform, collected through our platform provider and cookies.
  • Any other information you choose to share with us or within the Community.

We do not intentionally collect special category data (such as health information). Please avoid sharing sensitive personal information within the Community or with our AI chatbot where it is not necessary (see "AI Chatbot" below).

HOW WE COLLECT YOUR DATA

We collect personal data:

  • directly from you when you join, communicate with us, or participate in the Community;
  • automatically through cookies and similar technologies when you use our platform; and
  • from our service providers, such as our platform and payment providers.

HOW WE USE YOUR DATA AND OUR LAWFUL BASIS

Under UK data protection law we must have a lawful basis for processing your personal data. We use your data for the following purposes:

  • To provide and manage your membership and give you access to the Community – lawful basis: performance of a contract.
  • To take payment and manage billing – lawful basis: performance of a contract.
  • To communicate with you about your membership, live calls, resources and important updates – lawful basis: performance of a contract and our legitimate interests.
  • To respond to your enquiries and provide support – lawful basis: legitimate interests.
  • To maintain the safety, integrity and smooth running of the Community, including moderation – lawful basis: legitimate interests.
  • To send you marketing about our own services, where you have not opted out – lawful basis: legitimate interests (or consent where required). You can opt out at any time.
  • To comply with our legal and regulatory obligations – lawful basis: legal obligation.

Where we rely on legitimate interests, we have considered whether those interests are overridden by your rights, and we believe they are not. You can ask us for more information about this assessment.

SHARING YOUR DATA

We do not sell your personal data. We share it only with:

  • Platform provider – Kajabi, which hosts the Community and processes membership and account data on our behalf.
  • Payment providers – Stripe and/or PayPal, which process your payments.
  • AI provider – OpenAI, which operates the ChatGPT platform on which our chatbot is built (see below).
  • Other service providers – such as email, communications and administration tools that help us run the Community.
  • Professional advisers and authorities – where required for legal, accounting or regulatory reasons.

Our service providers act as our data processors and are only permitted to use your data in line with our instructions and applicable law.

AI CHATBOT

We provide an AI-powered chatbot, "The Feminine Way Guide", within the Community. It is a custom assistant built on the ChatGPT platform provided by OpenAI. When you use the chatbot, your messages are processed by OpenAI in accordance with OpenAI's own terms and privacy policy, and may be processed outside the UK. Because your inputs are handled by a third party, please do not enter sensitive personal information (such as detailed health, financial or confidential information) or the personal information of other people when using the chatbot.

INTERNATIONAL TRANSFERS

Some of our service providers (including OpenAI, and potentially our platform and payment providers) may process your personal data outside the UK. Where we transfer personal data outside the UK, we ensure appropriate safeguards are in place as required by UK data protection law, such as an adequacy decision or the International Data Transfer Agreement (or equivalent contractual safeguards). You can contact us for more information about these safeguards.

HOW LONG WE KEEP YOUR DATA

We keep your personal data only for as long as necessary for the purposes described in this policy. We retain membership and account data for the duration of your membership and for a reasonable period afterwards, and we keep payment and transaction records for as long as required by law (for example, for tax and accounting purposes, usually six years). When data is no longer needed, we securely delete or anonymise it.

HOW WE PROTECT YOUR DATA

We take appropriate technical and organisational measures to keep your personal data secure and to protect it against unauthorised access, loss, misuse or disclosure. While we take reasonable steps to protect your data, no method of transmission or storage is completely secure.

YOUR RIGHTS

Under UK data protection law, you have the right to:

  • be informed about how your data is used;
  • access a copy of the personal data we hold about you;
  • request correction of inaccurate or incomplete data;
  • request erasure of your data in certain circumstances;
  • restrict or object to our processing in certain circumstances;
  • data portability, where applicable; and
  • withdraw consent at any time, where we rely on consent.

To exercise any of these rights, please contact us using the details above. We will respond within one month, as required by law. There is usually no charge, though we may charge a reasonable fee or refuse a request that is manifestly unfounded or excessive.

Our platform uses cookies and similar technologies to operate the Community, remember your preferences and understand how the platform is used. You can manage non-essential cookies through your browser settings or any cookie controls we provide.Β 

MARKETING

We will only send you marketing communications in line with your preferences and applicable law. You can opt out at any time by using the unsubscribe link in our emails or by contacting us.

COMPLAINTS

If you have a concern about how we handle your personal data, we would encourage you to contact us first at [email protected] so we can try to resolve it. You have the right to make a complaint to us directly, and we will acknowledge and investigate your complaint and respond without undue delay.
